Injured by the driver of a rental car?
Central Florida is the home to wonderful weather and great attractions like Walt Disney World, Universal Studios and Sea World that bring tourists here from all over the world. Millions of tourists from all over the world come though Orlando each year. Many of these visitors will rent a car to get around town. What happens when a tourist from the United States or another country with little, or more often, no personal automobile liability insurance causes an accident? Tragically the answer often is the injured victim has no way to recover for their medical bills, lost wages and other economic and non-economic losses.Imagine you are driving down the road when a tourist accidentally runs a red light, causing injuries that will change your life forever. If that tourist was driving a rental car, often times the victim is not able to go to court to recover necessary medical expenses, damages and lost wages. This is because the victim is not able to pursue an action against the rental car company because the 2005 Graves Amendment provides protection for the rental car companies to avoid liability once they rent a car to someone even if that person has no liability insurance. Previously, Florida law would have allowed the victim to sue for up to about a half a million dollars for injuries to cover rehabilitation and lost wages. Under the current law, the multibillion dollar rental car corporations who put these people into rental cars without regard to their ability to drive or whether they have adequate insurance are protected from the claims of victims. This leaves the family to turn to the state and hospital system for their medical care, leaving taxpayers bearing the burden of the negligent tourist. The rental car companies and trial lawyers expect the Graves Amendment issue to end up in front of the U.S. Supreme Court very soon. We at the Kane Law Firm feel that the powerful lobbying done by these giant corporations have worked a terrible injustice and that the law should seek to protect people before it protects the profits of the special interest groups.
